Welcome to Wonderdawn Tiles and Marbles. These Terms and Conditions (“Terms”) govern your use of our website and the purchase of any products (including but not limited to tiles, marbles, natural stones, and related materials) from us. By placing an order, you agree to be bound by these Terms.
1. General Provisions
These Terms apply to all quotations, orders, and contracts for the sale of goods by [Company Name] (“Seller,” “We,” “Us”) to the buyer (“Customer,” “You”). Any variations to these conditions shall have no effect unless expressly agreed upon in writing by an authorized representative of [Company Name].
2. Product Characteristics and Natural Variations
Because we deal in both natural and manufactured surface materials, the Customer acknowledges the following:
- Natural Stone: Marble, granite, and natural stones are products of nature. They are subject to inherent variations in color, veining, shading, texture, and fissures. These natural characteristics are not considered material defects. Samples, showroom displays, and digital images are illustrative only and cannot guarantee an exact match to the supplied goods.
- Manufactured Tiles: Ceramic, porcelain, and vitrified tiles are subject to variations in shade and size (caliber) across different production batches (dye lots). Wonderdawn Tiles and Marbles cannot guarantee that tiles ordered at a later date will perfectly match previous orders.
3. Orders, Pricing, and Payment
- Order Acceptance: All orders are subject to product availability and acceptance by us. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product information.
- Pricing: All prices are subject to change without notice prior to order confirmation. Unless otherwise stated, prices exclude taxes, freight, and delivery charges, which will be calculated and added to the final invoice.
- Payment: Full payment is required before the dispatch of goods unless a pre-approved credit account has been established. Custom orders and cut-to-size stones require a non-refundable deposit at the time of order.
4. Shipping, Delivery, and Risk of Loss
- Delivery Estimates: Delivery dates provided are estimates only. Wonderdawn Tiles and Marbles shall not be liable for any direct or indirect losses, costs, or damages arising from delays in delivery.
- Curbside Delivery: All deliveries are made curbside. The Customer is responsible for moving the materials from the curb to the interior of the property or job site.
- Transfer of Risk: The risk of loss or damage to the goods passes to the Customer upon delivery to the agreed-upon location.
5. Inspection and Claims
- Duty to Inspect: The Customer or their authorized representative must be present at delivery to count and inspect the goods.
- Reporting Damage: Any visible damage, shortages, or delivery errors must be noted on the delivery receipt and reported to us in writing, accompanied by photographs, within 48 hours of receipt. Failure to report within this timeframe constitutes full acceptance of the goods in their delivered condition.
6. Returns and Cancellations
- Standard, uninstalled, and unopened materials in their original packaging may be returned within 30 days of delivery.
- All authorized returns are subject to a 20% restocking fee.
- The Customer is responsible for all return shipping costs.
- Custom-cut stones, special orders, clearance items, and installed materials are strictly non-returnable and non-refundable.
7. Installation Constitutes Acceptance
- It is the Customer’s and their installer’s responsibility to inspect the materials for color, sizing, and quality prior to installation. We strongly recommend “dry laying” the materials to blend variations.
- Waiver of Claims: The installation of the product constitutes full and final acceptance. Wonderdawn Tiles and Marbles shall accept no claims for visible defects, size differences, or color dissatisfaction once the material has been cut, modified, or installed.
8. Limitation of Liability
- Wonderdawn Tiles and Marbles shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use our products.
- We are not responsible for product failures resulting from improper installation, incorrect substrate preparation, structural movement, or the use of inappropriate setting materials and maintenance products. Our liability is strictly limited to the replacement of defective materials prior to installation or a refund of the purchase price.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India . Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Uttarakhand.
